San Diego criminal defense attorney Jessica McElfresh was recently contacted by a woman in her 40s arrested and charged with misdemeanor for driving under the influence of prescription drugs. Our client had been moving out of California on her way to Arizona when she was pulled over under suspicion of DUI. Our client had the medical condition of Fibromyalgia and had her prescription medication sitting in the center console. The officer performed a field sobriety test and determined our client failed and was arrested and charged with misdemeanor for driving under the influence of prescription drugs. Our client was taken to the police station and given a blood test to determine the type and amount of drugs in her system.

Our client immediately contacted San Diego criminal defense attorney Jessica McElfresh who requested the discovery evidence against her client in this case. When the results from the blood test of our client were sent to the attorney’s office it was discovered the lab made an error in processing the test results. After Jessica McElfresh brought this information to the attention of the prosecuting attorney Ms. McElfresh successfully negotiated the dismissal of all charges against her client.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
