Misdemeanor Driving Under the Influence of Drugs, Dismissed

San Diego criminal defense attorney Jessica McElfresh was recently contacted by a woman in her 40s arrested and charged with misdemeanor for driving under the influence of prescription drugs. Our client had been moving out of California on her way to Arizona when she was pulled over under suspicion of DUI. Our client had the medical condition of Fibromyalgia and had her prescription medication sitting in the center console. The officer performed a field sobriety test and determined our client failed and was arrested and charged with misdemeanor for driving under the influence of prescription drugs. Our client was taken to the police station and given a blood test to determine the type and amount of drugs in her system.

When the results from the blood test of our client were sent to the attorney’s office it was discovered the lab made an error in processing the test results.
