During a night out, and after drinking too much a young woman engaged in an argument with her boyfriend. The disagreement continued once they arrived home and escalated to pushing and shoving each other. The neighbors heard the commotion, became concerned, and alerted the police. Upon arrival, the couple, neither of whom had any criminal record attempted to de-escalate the situation by describing the quarrel as a simple misunderstanding. However, the officers saw that the boyfriend received a visible injury and charged the woman with domestic violence. She had to spend a couple of days in jail but sought San Diego criminal defense attorney Jessica McElfresh to help with this unfortunate circumstance.

Attorney McElfresh saw this as a typical situation where the police needed to remove a party from the residence to prevent further injury. We sent a letter explaining the details and upon review, the case was not forwarded to the district attorney for prosecution. Since the domestic violence charges were dropped, our client saw no repercussions and could move past this incident.

The outcome of an individual case depends on a variety of factors unique to that case. Case results do not guarantee or predict a similar result in any similar or future case.
