Cannabis attorney Jessica McElfresh was recently quoted in a San Diego Union-Tribune article on a circulating cannabis licensing scam involving predatory contracts pushed by a local consulting company. Jessica expressed her lack of surprise toward these one-sided agreements that potential licensees are being pressured to sign, saying “[t]he alleged path to riches attracts con artists, or people looking to make a quick buck…It’s not a problem unique to social equity.”

Jessica also highlighted the challenges faced by cannabis entrepreneurs, such as difficulties in opening bank accounts or securing small business loans due to the federal illegality of marijuana and the substantial revenue the industry generates. These factors, she noted, increase the risk of unethical practices and scams within both the general cannabis market and social equity initiatives.
